Lockdowns and other Government-imposed Covid curbs contain all the ingredients of totalitarianism, a former Supreme Court judge warns.
Orders to remain at home and rafts of new laws to restrict what people can do amount to a ‘breathtaking’ infringement of democratic rights, Lord Sumption will say in a speech tonight.
He has repeatedly warned that ministers have been exceeding their rightful powers but these criticisms are his strongest yet.
He will tell the Cambridge Law Faculty that the use of coercion to try to quell the pandemic is unprecedented in British history, even in wartime, and that it runs against basic freedoms.
Lord Sumption will accuse ministers of using the police to suppress opposition to their policies, of creating new criminal offences without the legal right to do so, and of grabbing unconstitutional powers by issuing misleading guidance.
He is to say the methods used by ministers will undo the unity of society and will lead to long-term authoritarian government.
Lord Sumption will say that ministers avoided Parliament through the Public Health Act which let them introduce lockdowns and other measures without the same level of scrutiny by the House of Commons or Lords.
Giving the Cambridge Freshfields annual law lecture, he will accuse the Government of ‘tendentiously’ presenting guidance as if it was law – such as the two-metre social distancing rule.
He will also say the Government gave police ‘unprecedented discretionary’ enforcement powers, some of which were used to suppress opposition to its policies, The Telegraph reports.
Lord Sumption will speak of new criminal offences brought into being on the ‘mere say-so of ministers’, with the fines of up to £10,000 ‘truly breathtaking’ constitutionally.
This has been achieved through the ‘language of impending doom’, ‘alarmist’ projections and statistical manipulation, he will say.
He will also give a chilling warning that the Government’s actions pose a severe threat to reshape the relationship between the state and the public in a shift to a more authoritarian style of politics, which will survive past the current crisis.
The intervention comes amid growing tension over rules meant to reduce infections, such as the Tier Three restrictions in northern England.

The problem with Lord Sumption and that Daily Fail columist who’s name slips my mind, is that they are lone voices and all they achieve is a pacifying effect where sheeple who disagree with the regimes actions, just vents. They now believe they aren’t alone, that someone speaks for them.
The reality is that Sumption and others are pretty mild and wishy-washy. Members of the regime are mass murderers. When a regime takes such damaging decisions, they should approach Lloyds of London to seek insurance for their actions… the loss of life through state murder, the lost of jobs and businesses & the trauma inflicted. If the regime can get the correct insurance cover, then they can act. If they can’t get full cover for their actions, they should cancel their plans.
The problem with suing the regime, is that tax payers foot the bill. This shouldn’t happen. Sure, LofL will collect a premium, but only if they offer to cover the risk. Millions of sheeple should be suing the regime. Just as people who paid into the EU project all their working lives should be suing the Conservative Party, because it was the Conservative party who allowed a large body of its members to hide in the shadows for decades when the Conservative party was very pro EU. Once again, the Conservatives should have taken out cover for their actions. If the Boy Scouts knowingly fails to vet the people who are responsible for the boys in their care and those people abuse those boys, they are liable… it would be even worst had senior BS brass known their empolyees were abusers. The facts is, the Conservatives allowed a boil to fester for decades & this has exploded in everyones face.
Like the designed 2008 financial collapse where the regime bailed out the banks and corporations, and took on their debts, the regime did this by borrowing from the same criminals which they bailed out.
Here we are with Brexit disaster and Covid, the other half of MI6s coin and they have massively destroyed peoples lives, businesses, jobs, health and futures, and the very SAME SHEEPLE will have to pay for the damage.
Any business which decides to follow xyz policies, knows that they and their investors carry the risk. The regime should act under the same framework. I very much doubt that Lloyds of London would cover the risks of Brexit or Covid, so on that basis alone, we shouldn’t be leaving the EU (-2.2% GDP before lockdown) & the the economy should never of been locked down.
Bonus example: millions of Londoners have had, or will have their legally purchased vehicles where all the taxes were paid, and Sadiq Khan has litterally reduced the value of said vehicles or made them worthless. Khan should have been forced to get cover from Lloyds of London for the potential costs. Of course, Khan wouldn’t be able to get cover, so end of policies.
