Calm and then chaos. Stupid move by Rayshard Brooks. Sorry for him and his family. Death is a very bad thing independent of the circumstances. Rayshard escalated his mistake by actually pointing as well as firing the taser ( I can see the flash from the confiscated taser at the direction of the officer).Tasers can be lethal and can also cause bodily harm (sufficient for the response of deadly force..i.e. firing a gun). The problem however with this officer’s response was that he fired quickly 3 rounds AFTER the taser was fired at him while Rayshard continued to run. An immediate interpretation for the prosecution is that Rayshard at that point no longer posed a threat and that the officer is guilty of at least manslaughter. Defense attorney could counteract by saying if Rayshard fired a handgun at the police officer instead of the taser would this interpretation be different ? I can almost guarantee that if Rayshard fired a hand gun and continued to run this scenario even with the timing off of officer’s deadly force response would be seen in a different light. Therefore if the taser could be somewhat be made equivalent to a handgun this officer may have a chance for acquittal. I know there is a stretch here. However in this recent light of overwhelming and perhaps allowed extreme massive demonstrations the political desperate moves by those in power will be made and this officer is probably cooked. All in all we probably have an individual intoxicated who has made 4 stupid moves (hitting an officer, grabbing away a taser, running away from an arrest, and firing a taser at the officer.) The main problem again is the grey ( but important area) of the delay of the use of deadly force ( which led to Rayshard’s death). Of course years ago this would almost be considered a “clean ” kill in self defense by the authorities. Again my sincere sympathies for the family of Rayshard Brooks.
