Universal jurisdiction allows governments to prosecute individuals for serious crimes, regardless of where they\u2019ve been committed. The case itself was the result of a complaint filed by the Hind Rajab Foundation (HRF), a Belgium-based legal group pursuing action against perpetrators, accomplices, and inciters of war crimes and crimes against humanity in Palestine. Since its establishment, the foundation has submitted more than 30 complaints against members of Israel\u2019s military \u2014 from senior-level officials to lower-ranking personnel \u2014 around the world, as well as filing a <a href=\"https:\/\/www.hindrajabfoundation.org\/perpetrators\/hind-rajab-foundation-files-historic-icc-complaint-against-1000-israeli-soldiers-for-war-crimes-in-gaza\">complaint<\/a> with the International Criminal Court (ICC) against 1,000 Israeli soldiers (including dual nationals from France, the United States, Canada, the United Kingdom, and the Netherlands) for war crimes, crimes against humanity, and genocide in Gaza<\/p>\n<div align=\"center\">\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">We have officially submitted our ICC complaint along with the evidence, to 8 countries through their embassies in The Hague.<br \/>\nWe call on these countries to issue Interpol arrest warrants against 1000 Israeli soldiers.<br \/>\nAmong these countries are Spain, Ireland, and South Africa.<\/p>\n<p>\u2014 The Hind Rajab Foundation (@HindRFoundation) <a href=\"https:\/\/twitter.com\/HindRFoundation\/status\/1845051529964765683?ref_src=twsrc%5Etfw\">October 12, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<\/div>\n<h2 style=\"text-align: center;\"><strong>Tracking War Crimes<\/strong><\/h2>\n<p>HRF\u2019s complaints are primarily based on information Israeli soldiers have posted on social media engaging in possible war crimes, such as the destruction and occupation of Palestinian civilian infrastructure and looting of personal belongings.<\/p>\n<p>\u201cNever before have we seen a national military organization like the IOF [Israel Occupation Forces] publishing their crimes,\u201d HRF\u2019s lead lawyer, Haroon Raza, told MintPress News. \u201cThey think they\u2019re superior. The only way in which you can publish this stuff is when you think you\u2019re right, because the other side is inferior as a people.\u201d<\/p>\n<p>But it\u2019s not just HRF that\u2019s motivated to hold Israeli soldiers accountable. An X account called \u201cIsrael Genocide Tracker\u201d documents Israeli soldiers\u2019 activities in Gaza and Lebanon, as well as where soldiers spend their vacations. So we felt that it was important to take a civil society initiative in the case of these soldiers.\u201d<\/p>\n<p>\u201cWhere our government won\u2019t act, civil society will,\u201d Minto added.<\/p>\n<p>Reports emerged that New Zealand had changed its visa requirements, requiring Israeli visitors to disclose their military service during the application process. However, the country\u2019s Immigration Ministry <a href=\"https:\/\/www.haaretz.com\/world-news\/asia-and-australia\/2025-02-02\/ty-article\/.premium\/new-zealand-denies-reports-on-new-requirements-from-israeli-visitors\/00000194-c37d-d7dd-a7f5-e77da7ce0000\">denied<\/a> these reports, saying its policies hadn\u2019t changed.<\/p>\n<p>Minto said that despite New Zealand\u2019s Human Rights Commissioner, Stephen Rainbow, requesting the hotline be taken down, it\u2019s still active and has received over 200 calls since its launch on January 22, 2025. Minto said the goal is to then hang posters outside where Israeli soldiers are staying, organize protests in front of these accommodations, and hand out leaflets to guests.<\/p>\n<p>\u201cIf we know Israeli soldiers are there, [then we] look for any opportunity to tell these Israeli soldiers they\u2019re not welcome here,\u201d Minto said.<\/p>\n<p>In response to Israeli soldiers facing increased targeting abroad for their involvement in Israel\u2019s war on Gaza, Israel\u2019s military <a href=\"https:\/\/www.theguardian.com\/world\/2025\/jan\/08\/idf-restricts-media-coverage-of-soldiers-to-protect-them-from-risk-of-legal-action\">tightened restrictions<\/a> on media coverage of soldiers in January. Under the new rules, press interviewing soldiers with the rank of colonel and below can\u2019t publish their full names and faces and can\u2019t be linked to a specific combat operation. Additionally, military personnel with multiple citizenships must have their faces obscured and names not disclosed in interviews.<\/p>\n<p>While announcing the new protocols, Lt Col Nadav Shoshani, an Israeli military spokesperson, said soldiers weren\u2019t allowed to post footage from war zones on social media under existing military rules \u201ceven though that\u2019s never perfect and we have a large army.\u201d<\/p>\n<p>Even before a Brazilian court ordered an investigation into Israeli reservist Vagdani, Israel\u2019s National <a href=\"https:\/\/www.israeldefense.co.il\/en\/node\/63789\">Cyber Directorate<\/a> was already warning soldiers serving in Gaza about posting on social media and keeping their profiles public after a discharged soldier shared photos from the frontlines. The images led to activists publishing his identity while he was on holiday in Prague.<\/p>\n<p>\u201c[The directive] didn\u2019t say don\u2019t commit crimes; it says don\u2019t publish them,\u201d HRF\u2019s Raza said,\u00a0 emphasizing it\u2019s too late now.<\/p>\n<p>\u201cEverything has already been saved,\u201d Raza said, referring to HRF and other organizations\u2019 databases, which can save information whether it remains online or not.<\/p>\n<h2 style=\"text-align: center;\"><strong>How governments are cracking down (or not)<\/strong><\/h2>\n<p>Having long evaded international accountability for its continued violence against Palestinians, Israel is now facing scrutiny worldwide.<\/p>\n<p>On November 21, 2024, the <a href=\"https:\/\/www.icc-cpi.int\/news\/situation-state-palestine-icc-pre-trial-chamber-i-rejects-state-israels-challenges\">ICC<\/a> issued arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Israeli Defense Minister Yoav Gallant over crimes against humanity and war crimes allegedly committed during Israel\u2019s war on Gaza. Countries that are party to the ICC and thereby legally obligated to implement its decisions have been split about whether they\u2019ll comply with the warrants.<\/p>\n<p>According to Just Security, an online publication focused on national security, <a href=\"https:\/\/www.justsecurity.org\/105064\/mapping-state-reactions-icc\/\">over 30<\/a> out of the 125 countries that are party to the ICC have promised to abide by the court\u2019s decision, including Canada, the UK, Chile, Jordan, and South Africa. Meanwhile, 13 countries, also ICC signatories, have announced they won\u2019t comply, haven\u2019t committed to upholding the warrants, or expressed criticism over the ICC\u2019s decision, including China, Australia, Italy, Sweden, Argentina, Hungary, and Austria.<\/p>\n<p>Some countries have also recently changed their positions, such as Germany, which shifted its stance from suggesting it wouldn\u2019t comply with the warrants to now indicating it would uphold the law. On the other hand, France hinted it may not arrest Netanyahu, arguing he has immunity given Israel is not a party to the ICC.<\/p>\n<p>\u201cSuch immunities apply to Prime Minister Netanyahu and other relevant ministers and will need to be taken into consideration should the ICC request their arrest and surrender,\u201d the French Foreign Affairs Ministry announced.<\/p>\n<p>The U.S., which isn\u2019t an ICC party and has largely funded Israel\u2019s war on Gaza, recently <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/imposing-sanctions-on-the-international-criminal-court\/\">sanctioned<\/a> the court \u2014 citing arrest warrants for Netanyahu and Gallant in its reasoning\u2014 at the start of President Donald Trump\u2019s second term. The sanctions <a href=\"https:\/\/www.aljazeera.com\/features\/2025\/2\/7\/why-has-trump-hit-the-world-criminal-court-with-sanctions\">may hinder<\/a> ongoing investigations, making it difficult for ICC officials to travel and access funds or scaring individuals from cooperating with ICC probes.<\/p>\n<p>On July 19, 2024, the <a href=\"https:\/\/www.icj-cij.org\/node\/204176\">International Court of Justice<\/a> (ICJ) ruled Israel\u2019s occupation of the Gaza Strip and the West Bank, including East Jerusalem, is unlawful and must end \u201cas rapidly as possible.\u201d The court also ruled Israel must stop all new settlement activity, pay reparations to Palestinians, and affirmed some of Israel\u2019s policies in the occupied Palestinian territories (oPt) amount to apartheid.<\/p>\n<p>In light of the ICJ\u2019s opinion, the Brussels Parliament passed a <a href=\"https:\/\/www.alhaq.org\/advocacy\/25895.html\">resolution<\/a> on February 3, 2025, placing an arms embargo and trade restrictions on Israel. The resolution now heads to the European Commission, the European Union High Representative for Foreign Affairs and Security Policy, and to the Belgian federal government for final approval.<\/p>\n<p>Also in response to the ICJ\u2019s ruling, Ireland decided to revive its <a href=\"https:\/\/www.alhaq.org\/advocacy\/24812.html\">Occupied Territories Bill,<\/a> which criminalizes trade between the country and Israeli settlements in the oPt. The bill was introduced in 2018 but has stalled over claims it goes against EU trade law, which Ireland, as an EU member state, is beholden to. Both Ireland and Belgium are ICC party states and have stated they will comply with the ICC arrest warrants against Netanyahu and Gallant.<\/p>\n<p>In the Netherlands, a coalition of Palestinian and Dutch civil society groups organizations sued the state in October 2024 for failing to prevent genocide, which the Netherlands, as a signatory to the Genocide Convention, is legally bound to.<\/p>\n<p>\u201cYet, despite mounting evidence, <a href=\"https:\/\/www.ohchr.org\/en\/statements\/2024\/09\/un-experts-warn-international-order-knifes-edge-urge-states-comply-icj-advisory\">UN expert warnings<\/a>, <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/186\/186-20240719-adv-01-00-en.pdf\">and the most recent ICJ Advisory Opinion<\/a>, the Dutch government continues to export arms and dual-use goods to Israel, contributing to severe human rights violations in Gaza,\u201d Law for Palestine, one of the parties supporting the case, said in a <a href=\"https:\/\/law4palestine.org\/dutch-and-palestinian-ngos-take-legal-action-against-dutch-government-over-genocide-in-gaza-and-international-law-violations\/\">statement<\/a>.<\/p>\n<p>More recently, on January 31, 2025, representatives from nine countries convened in The Hague, Netherlands, to establish <a href=\"https:\/\/thehaguegroup.org\/\">The Hague Group<\/a>, an international alliance committed to holding Israel accountable under international law. The founding members\u2014Belize, Bolivia, Colombia, Cuba, Honduras, Malaysia, Namibia, Senegal, and South Africa\u2014announced their shared objectives in an inaugural statement that referenced the International Court of Justice\u2019s opinion and the International Criminal Court\u2019s arrest warrants for Israeli officials.<\/p>\n<p>The group <a href=\"https:\/\/progressive.international\/wire\/2025-01-31-pi-briefing-no-4-history-in-the-hague\/en\">pledged<\/a> to uphold the ICC\u2019s arrest warrants, ensuring their enforcement against Israeli officials. It also <a href=\"https:\/\/progressive.international\/wire\/2025-01-31-pi-briefing-no-4-history-in-the-hague\/en\">committed<\/a> to preventing the provision or transfer of arms, munitions, and related equipment to Israel in cases where there is a clear risk of their use in violations of international law. Additionally, The Hague Group vowed to block the docking of vessels at their ports if there is a risk that the ships are transporting military fuel or weaponry to Israel.<\/p>\n<p>\u201cIt was born out of necessity given Israel\u2019s ongoing crimes against the Palestinians, breaches of international law, and the wider attacks on international law and accountability, as we saw in the previous U.S. administration and that have been sped up by the new U.S. administration,\u201d James Schneider with Progressive International, which convened the historic meeting, told MintPress News, referring to Trump\u2019s ICC sanctions.<\/p>\n<p>While initially, public resistance to Israel and support for the Palestinian people in the wake of Hamas\u2019 2023 attack was low, Raza remarked, this attitude has now changed over a year later.<\/p>\n<p>\u201cFinally, Amnesty [International] and all the other organizations woke up to their responsibilities,\u201d Raza said, recalling the human rights group\u2019s December 2024 <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/12\/amnesty-international-concludes-israel-is-committing-genocide-against-palestinians-in-gaza\/\">report<\/a> concluding Israel is committing genocide. \u201cThere is a clear pattern of human rights violations or crimes against humanity, et cetera, which has resulted\u2026in even legally calling it genocide.\u201d<\/p>\n<p>\u201cYou see very slowly, especially because of the ICJ rulings, that things are starting to change,\u201d Raza added.<\/p>\n<p>A precedent has been set, and Israeli crimes are no longer being ignored by the international community. For the first time, Israel might not be able to escape accountability.<\/p>\n<p>\u201cPeople who have committed war crimes from Israel are scared,\u201d Raza said.<\/p>\n<p style=\"padding-left: 40px;\">We\u2019ve got them literally on the run, which hadn\u2019t happened up until now. Foot soldiers and corporals and captains, et cetera always thought that they could keep on vacationing in Europe and other exotic places, and they can\u2019t do that anymore.
