Gavin Newsom (D-CA) signed a controversial bill into law Friday that will give judges greater discretion to decide whether adults who commit sodomy with minors should be placed on California\u2019s sex offender registry.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">The bill, which passed the Democrat-led legislature last week, <span style=\"text-decoration: underline;\"><strong><a style=\"color: #ccffff; text-decoration: underline;\" href=\"https:\/\/www.breitbart.com\/politics\/2020\/09\/03\/california-legislature-passes-bill-reduce-penalties-oral-anal-sex-willing-children\/\">created<\/a><\/strong><\/span> a firestorm as proponents said its main purpose was to end discrimination against LGBT adults who have oral and anal sex with minors who claim to be consenting to the sexual activity<\/span><\/p>\n<p><span style=\"color: #ccffff;\">State Sen. Scott Wiener (D), who introduced the legislation, said in a statement on social media the new law would put an end to \u201cblatant discrimination against young LGBT people engaged in consensual activity.\u201d<\/span><\/p>\n<p><span style=\"color: #ccffff;\">\u201cIt\u2019s appalling that in 2020, California continues to discriminate against LGBTQ people, by mandating that LGBTQ young people be placed on the sex offender registry in situations where straight people aren\u2019t required to be placed on the registry,\u201d Wiener said.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Proving again he\u2018s a true champion for the LGBTQ community \u2014 even when it\u2019s hard \u2014 Gov Newsom signed <a href=\"https:\/\/twitter.com\/hashtag\/SB145?src=hash&amp;ref_src=twsrc%5Etfw\">#SB145<\/a>, ending discrimination against LGBTQ young people on CA\u2019s sex offender registry.<\/p>\n<p>Thank you for seeing through the QAnon lies about this equality legislation. The facts are clear: SB 145 simply ends anti-LGBTQ discrimination. Today, California took yet another step toward an equitable society.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">Wiener<span style=\"text-decoration: underline;\"><strong> <a style=\"color: #ccffff; text-decoration: underline;\" href=\"https:\/\/www.sfexaminer.com\/news\/wiener-legislation-seeks-to-end-blatant-discrimination-in-sex-offender-registry-laws\/\">claimed<\/a>\u00a0<\/strong><\/span>the existing law, which states oral and anal sex between an adult within ten years of the age of a consenting minor requires the adult to be registered as a sex offender, discriminates against LGBT individuals:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #ccffff;\">This bill is about treating everyone equally under the law. Discrimination against LGBT people is simply not the California way. These laws were put in place during a more conservative and anti-LGBT time in California\u2019s history. They have ruined people\u2019s lives and made it harder for them to get jobs, secure housing, and live productive lives. It is time we update these laws and treat everyone equally.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">Existing state law allows judges to decide whether adults who have \u201cpenile-vaginal intercourse\u201d with minors must register as a sex offender.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">Wiener said the current law targets LGBT individuals because they do not engage in penile-vaginal intercourse<\/span><\/p>\n<p><span style=\"color: #ccffff;\">\u201cThis is such horrific homophobia,\u201d Wiener\u00a0<span style=\"text-decoration: underline;\"><strong><a style=\"color: #ccffff; text-decoration: underline;\" href=\"https:\/\/www.sfchronicle.com\/politics\/article\/Keeping-gay-men-off-California-s-sex-offender-13826028.php\">said<\/a><\/strong><\/span>, according to the\u00a0<em>San Francisco Chronicle<\/em>. \u201cIt\u2019s irrational, and it ruins people\u2019s lives.\u201d<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Right wing playbook on all efforts to achieve LGBTQ equality:<\/p>\n<p>\u2705 Falsely claim children will be harmed or raped<\/p>\n<p>\u2705 Say that God is mad that LGBTQ people are more equal<\/p>\n<p>\u2705 Blame CA natural disaster on God being made at the gays, while ignoring hurricanes\/tornadoes in red states <a href=\"https:\/\/t.co\/nGIYmTUDkk\">https:\/\/t.co\/nGIYmTUDkk<\/a><\/p>\n<p>&mdash; Senator Scott Wiener (@Scott_Wiener) <a href=\"https:\/\/twitter.com\/Scott_Wiener\/status\/1303018265841553408?ref_src=twsrc%5Etfw\">September 7, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"color: #ccffff;\">The primary stated goal of the measure appears to be to end automatic addition to the state\u2019s sex offender registry list for adults who have oral or anal sex with a minor.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">The Senate Floor Analysis of SB 145<span style=\"text-decoration: underline;\"><strong> <a style=\"color: #ccffff; text-decoration: underline;\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=201920200SB145\">states<\/a><\/strong><\/span> the measure:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #ccffff;\">Exempts a person convicted of non-forcible sodomy with a minor, oral copulation with a minor, or sexual penetration with a minor, as specified, from having to automatically register as a sex offender under the Sex Offender Registry Act if the person was not more than 10 years older than the minor at the time of the offense, and the conviction is the only one requiring the person to register.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #ccffff;\">California fails to mandate registration as a sex offender who commits a violation of sexual intercourse with a minor who is within 10 years of the offender. Sexual penetration is distinguishable from sexual intercourse in that the vaginal penetration is anything other than a penis.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">\u201cAdditionally, the crimes of sexual conduct with a minor under the age of 14 are punished in a separate code section, as lewd and lascivious acts with a minor under the age of 14,\u201d the analysis also said.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">\u201cThis bill allows judges and prosecutors to evaluate cases involving consensual sex acts between young people, regardless of their sexual orientation, on an individual basis,\u201d <a style=\"color: #ccffff;\" href=\"https:\/\/www.usatoday.com\/story\/news\/factcheck\/2020\/09\/03\/fact-check-california-law-does-not-decriminalize-sex-minors\/3456171001\/\"><span style=\"text-decoration: underline;\"><strong>said<\/strong><\/span>\u00a0<\/a>Jackie Lacey, the Los Angeles County district attorney who wrote and sponsored the bill, reported <em>USA Today<\/em>.\u00a0\u201cI drafted this bill because I believe the law must be applied equally to ensure justice for all Californians.\u201d<\/span><\/p>\n<p><span style=\"color: #ccffff;\">The legislation\u2019s supporters are clearly focused on the newfound equality for adults engaging in any variety of sex act with minors who are as young as 14 years old. With the new law, adults who have either vaginal intercourse or oral\/anal sex with young teens have an equal chance of keeping their names off the California sex offender registry if they can convince a judge the sex was \u201cconsensual.\u201d<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Well what a shock. Newsom signed SB145, the bill that allows a 24 year old to have sex with a 14 year old and escape a felony conviction and requirement to be a registered sex offender. Absolutely disgusting.<\/p>\n<p>&mdash; Senator Melissa Melendez (@senatormelendez) <a href=\"https:\/\/twitter.com\/senatormelendez\/status\/1304619709682384896?ref_src=twsrc%5Etfw\">September 12, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"color: #ccffff;\">The <em>Washington Examiner<\/em> reported Democrat Assemblywoman Lorena Gonzalez <span style=\"text-decoration: underline;\"><strong><a style=\"color: #ccffff; text-decoration: underline;\" href=\"https:\/\/www.washingtonexaminer.com\/news\/gov-newsom-signs-controversial-bill-into-law-reducing-penalties-for-sexual-relations-with-minors\">said<\/a><\/strong><\/span> as the bill was being debated:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #ccffff;\">I cannot in my mind as a mother understand how sex between a 24-year-old and a 14-year-old could ever be consensual, how it could ever not be a registrable offense. We should never give up on this idea that children should be in no way subject to a predator.<\/span><\/p>\n<p><span style=\"color: #ccffff;\">San Diego Mayor Kevin Faulconer (R) also tweeted after Newsom signed the bill into law, \u201cAs a parent I\u2019m appalled that last night our governor signed a law maintaining a 24-year-old can have sex with a 14-year-old and it not be considered predatory.\u201d<\/span><\/p>\n<p><span style=\"color: #ccffff;\">\u201cAn adult who commits ANY sex act on a minor 10 years younger must be registered a sex offender,\u201d he added. \u201cLaw must be changed.\u201d<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">As a parent I\u2019m appalled that last night our governor signed a law maintaining a 24-year-old can have sex with a 14-year-old and it not be considered predatory.<\/p>\n<p>An adult who commits ANY sex act on a minor 10 years younger must be registered a sex offender.
